The H2B visa is one option available to employers of foreign non-professionals. As with other types of visas, the H2B may bring dependent family members to the U.S. Also, it is possible, in some cases, for employers to file blanket petitions, that is, one petition for several individual employees.

First, this visa is only available for work that is temporary in nature. There are four situations where work is considered temporary in nature for H2B purposes:

·         Recurring seasonal need;

·         Intermittent need;

·         Peak-load need; and

·         One time occurrence.

Second, the employer must establish that there are no unemployed U.S. workers willing or able to do the work. This is established through the states’ employment agency using a labor certification process.

If the prospective worker (beneficiary) is outside of the country, he must apply for a visa. After the USCIS has approved the I-129 and sent notice to the consulate in the beneficiary’s country, the beneficiary must file a visa application with the consulate. 

Returning H2B (H2R) Workers

The Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and Tsunami Relief, 2005, P.L. 109-13, 119 Stat. 231, was signed into law by the President on May 11, 2005.  The Act provides that if an applicant has been issued an H2B visa based on an approved petition in any of the previous three fiscal years, the applicant is not counted against the current fiscal year's annual limit.  If you are a RETURNING WORKER who wish to work in the USA next season please click here

 A single petition may cover multiple workers if:

  • they will perform the same services
  • they will work in the same location
  • they are included on the same labor certification and,
  • they come from places that are served by the same U.S. consulate, or, if visa exempt, they will enter at the same port of entry.
